Trusts are similar to guardianships in terms of one of their main benefits: "safe-keeping" of assets. Because of this, guardianships and trusts are often complementary or supplemental, and attempts continue to be made to utilize both appropriately. For example, there are attempts to use trusts as a means of controlling guardians from abusing their authority and committing fraud, such as misappropriating the person under the guardianship's property, and there are attempts to use trusts as a means of ensuring the person under the guardianship's safety while avoiding the guardianship system's excessive restrictions on the person under the guardianship's rights. In Korea, creative attempts to utilize trusts from both perspectives continue. This article examines Japan's guardianship support trusts, which were introduced to prevent guardianship fraud, and special needs trusts, which are used in the United States as an alternative to guardianship, and introduces examples of trusts related to guardianship in Korea from the author's experience and points out problems in practice. In any case, in order for trusts linked to guardianship to be widely utilized, trust practices need to be improved so that they can be operated in a way that is more convenient for users and does not contradict the nature of the trust.
